About these terms
These Terms and Conditions explain the basis on which FITPRO-X Limited supplies education, training, assessment support, digital learning materials, mentoring, career support and related services. They also govern use of the FITPRO-X website and learner platforms where these terms are incorporated.
A learner’s enrolment may also be subject to a course specification, enrolment form, funding agreement, payment plan, learner handbook, awarding organisation requirements and platform rules. If documents conflict, mandatory law and the learner’s statutory rights take priority, followed by any individually agreed written terms and then these Terms and Conditions.

Definitions
- “Course” means any qualification, programme, workshop, bootcamp, mentoring package or other learning service supplied by FITPRO-X.
- “Learner” or “you” means the person enrolled on, applying for or purchasing a Course.
- “Course Materials” means videos, text, workbooks, assessments, templates, downloads and other content made available as part of a Course.
- “Funded Course” means a Course paid for wholly or partly by a public body, employer, college, partner or other funding organisation.
- “Partner” means an awarding organisation, funding organisation, gym, employer, assessor, tutor, finance provider, technology provider or delivery partner involved in the Course.
Course information and eligibility
We aim to describe each Course accurately, including its content, delivery method, expected duration, entry requirements, assessment arrangements, price and any qualification outcome. Images, timetables and examples are illustrative unless stated otherwise.
You must provide complete and accurate information during enquiry and enrolment. You must tell us before enrolment about any accessibility needs, health considerations, injuries, language support needs or other circumstances that may affect safe participation or reasonable adjustments. We will consider reasonable adjustments in line with applicable law and awarding organisation rules.
Some Courses require minimum age, identity, residency, prior qualification, English-language, employment, funding or fitness-to-participate criteria. Enrolment is not confirmed until FITPRO-X has accepted the application and any required checks, evidence and payment arrangements are complete.
Forming the contract
A request for information, application or checkout submission is an offer to enrol. A binding contract is formed when FITPRO-X sends written confirmation of enrolment or grants Course access, whichever occurs first, unless the communication clearly states that further checks remain outstanding.
Where another organisation contracts with or funds FITPRO-X for your training, that organisation may be the contracting customer. You must still follow the learner-facing provisions of these terms, the learner handbook and applicable Course rules.
Prices, VAT and payment
- Course prices will state whether VAT is included. Where VAT is chargeable, it will be applied at the prevailing rate.
- Payment must be made by the date and method stated in the booking or payment plan. You are responsible for ensuring that payment details are accurate and authorised.
- Where an instalment plan is provided directly by FITPRO-X, all instalments remain payable unless the contract is lawfully cancelled or FITPRO-X agrees otherwise in writing.
- Where a third-party finance provider is used, the finance agreement is separate from these terms. The provider’s eligibility, credit, cancellation and repayment rules also apply. FITPRO-X cannot amend a third-party finance agreement.
- We will not charge optional extras without your express agreement. Any additional fee, resit fee, replacement certificate fee or transfer fee will be disclosed before it is incurred.
Refunds
Once a learner has accessed the programme, including the online learning platform, course materials, lessons, assessments or any other programme content, they will no longer be eligible for a commercial refund.
Where programme access is provided during the statutory cancellation period, the learner must expressly consent to the programme commencing immediately and acknowledge that, once digital content is supplied, they may lose their statutory right to cancel.
Where the required consent and acknowledgement have been obtained and the learner has accessed the programme, no refund will be provided for a change of mind, non-attendance, failure to complete the programme or a decision to discontinue their studies.
This does not affect any statutory rights or remedies that cannot legally be excluded, including rights arising where digital content or services do not meet applicable legal requirements.
FITPRO-X refunds, transfers and deferrals
Any commercial refund, transfer or deferral offered by FITPRO-X is additional to statutory rights. Course-specific terms may apply and will be provided before enrolment where they differ from this section.
- Once a learner has accessed the programme, including the online learning platform, course materials, lessons, assessments or other programme content, they will not normally be eligible for a commercial refund.
- Where the learner has expressly consented to immediate access to digital programme content and acknowledged the resulting loss of their statutory cancellation right, no refund will be available for a change of mind once that content has been accessed.
- Requests made before programme access has begun will be considered in line with the applicable statutory cancellation period and the learner’s course-specific terms.
- A transfer or deferral may be offered at FITPRO-X’s discretion where this is reasonable and permitted by the relevant awarding organisation, funding arrangement and course requirements.
- Accessing the programme and subsequently choosing not to continue, failing to attend, failing to complete assessments or becoming inactive does not create an entitlement to a refund.
- Any non-recoverable awarding organisation, registration, assessment, administration or other costs already incurred may be taken into account where a refund is legally due or where FITPRO-X agrees to provide a discretionary refund.
- Nothing in these terms limits statutory rights or remedies that cannot legally be excluded. This includes applicable remedies where services have not been performed with reasonable care and skill or digital content does not meet statutory requirements.
- Funded learners will not receive a cash refund for sums they did not personally pay. Withdrawal may affect funding eligibility and may require information to be provided to the relevant funder in accordance with the applicable funding rules.
Course delivery and access
- Courses may be delivered online, in person, through blended learning, at partner gyms or through third-party platforms.
- Start dates, session dates, tutors, assessors, venues and platforms may change where reasonably necessary. We will give reasonable notice and avoid materially reducing the Course outcome.
- Access credentials are personal and must not be shared. You must keep login information secure and tell us promptly about suspected unauthorised access.
- You are responsible for suitable internet access and a compatible device for online learning unless we agree otherwise.
- Course access may be time-limited. The applicable access period will be stated in the Course information or enrolment confirmation.
Learner responsibilities
- Attend and participate as required, meet deadlines and maintain reasonable contact with FITPRO-X.
- Complete work honestly and comply with assessment, plagiarism, authenticity and malpractice rules.
- Behave respectfully toward staff, learners, partner staff, employers and members of the public.
- Follow health and safety, safeguarding, equality, gym, venue, online conduct and data protection requirements.
- Disclose information relevant to safe practical participation and stop an activity if you feel unwell, unsafe or unable to continue.
- Not record sessions, copy materials, use another person’s work or distribute confidential information without permission.
Practical training and assessment
Practical activity involves physical exertion and may involve ordinary instruction, demonstration and correction. You must follow safety instructions and disclose relevant restrictions. FITPRO-X does not provide medical diagnosis or treatment, and you should seek appropriate medical advice where necessary.
Assessment decisions must meet awarding organisation standards. Completion of learning activities does not guarantee a pass. Resubmission, resit, appeal and reasonable adjustment arrangements are governed by the applicable assessment policies and qualification rules.
Certificates are issued or authorised by the relevant awarding organisation after achievement has been confirmed and any quality assurance or administrative requirements are complete. Timescales may depend on third parties.
Funded learning
For a Funded Course, you must meet the relevant eligibility and evidence requirements and cooperate with audits, attendance checks, progress reviews and outcome reporting. Funding may be withdrawn if information is inaccurate, eligibility changes or participation requirements are not met.
FITPRO-X may need to share learner information with funders, government departments, colleges, auditors, awarding organisations, delivery partners and employers where lawful and necessary. Further information is provided in our Privacy Policy and any programme-specific privacy notice.
Career, interview and placement support
Career support, introductions, interviews, mentoring and placement assistance are support services. Unless a specific written guarantee states otherwise, FITPRO-X does not guarantee employment, earnings, self-employment income, gym rental terms, visa eligibility, finance approval or any particular career outcome.
Employment and placement decisions are made by the relevant employer or partner. You remain responsible for applications, conduct, qualifications, insurance, registrations and legal requirements for work.
Intellectual property
Course Materials, website content, trade marks, designs, videos, workbooks and other materials are owned by or licensed to FITPRO-X. Subject to payment and compliance with these terms, you receive a limited, personal, non-transferable licence to use Course Materials for your own learning and professional development.
You must not reproduce, sell, publish, upload, share, adapt, reverse engineer or use Course Materials to create a competing course or commercial product without written permission. You retain ownership of your original assessment work but grant FITPRO-X and relevant Partners permission to use it for assessment, quality assurance, audit and regulatory purposes.
Suspension and termination
We may suspend access or terminate enrolment where there is serious or repeated non-payment, fraud, abuse, threats, harassment, safeguarding risk, unsafe conduct, academic misconduct, unauthorised sharing, material breach or a legal or regulatory requirement. Where appropriate, we will explain the concern and give a reasonable opportunity to respond.
Termination does not automatically remove sums lawfully due. Any refund or further payment will be determined by law, these terms, the services already supplied and the circumstances of termination.
Changes, cancellation by FITPRO-X and force majeure
We may make reasonable changes to improve content, meet awarding organisation or legal requirements, replace unavailable staff or venues, or respond to events outside our reasonable control. We will aim to provide a suitable alternative where a material part of a Course cannot proceed.
If FITPRO-X cancels a paid Course and cannot offer a reasonable alternative, we will refund the amount paid for the part not supplied. We are not responsible for avoidable or indirect travel, accommodation, loss of earnings or other costs unless liability cannot lawfully be excluded.
Our responsibility to you
We will provide services with reasonable care and skill. Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or statutory consumer rights.
Subject to the paragraph above, FITPRO-X is not responsible for losses that were not reasonably foreseeable when the contract was formed, losses caused by your breach, or business losses where you contract as a consumer. Any limitation will be applied fairly and in accordance with law.
Data protection, photography and communications
We process personal information in accordance with our Privacy Policy and applicable data protection law. Course communications may be sent by email, telephone, SMS, platform notification or other contact method supplied by you.
We will obtain an appropriate permission or identify another lawful basis before using identifiable photographs, video, testimonials or case studies for marketing. Refusing optional marketing use will not affect access to the Course.
Complaints and appeals
Please raise service concerns promptly so that we can investigate. Complaints should be sent to [email protected] with the learner name, Course, relevant dates, what happened and the outcome sought. Assessment appeals must follow the separate assessment appeals process and applicable awarding organisation deadlines.
We aim to acknowledge a complaint promptly and provide a substantive response within a reasonable period. If a matter falls within a Partner’s remit, we may refer or escalate it and will explain the route available.
Website use and third-party services
You may use the website only for lawful purposes. You must not attempt unauthorised access, introduce malicious code, scrape restricted content, interfere with systems or misuse forms and communications.
The website may link to third-party platforms, gyms, finance providers, awarding organisations, employers and social networks. Third-party terms and privacy practices apply to those services. A link does not make FITPRO-X responsible for third-party content or decisions.
General legal terms
- If any provision is invalid or unenforceable, the remaining provisions continue to apply.
- A delay in enforcing a right does not waive that right.
- You may not transfer your contract without written agreement. FITPRO-X may transfer its rights and obligations where this does not reduce your protections.
- These terms do not create rights for a person who is not a party to the contract, except where law provides otherwise.
- These terms are governed by the law of England and Wales. Consumers retain any mandatory right to bring proceedings in the part of the UK where they live.
